Riassunto This document is part of a series of studies, which, in a comparative law perspective, seek to present the principles of
equality and non-discrimination in different States. This study examines sources of equality law and judicial
interpretation of the principles of equality and non-discrimination in Canada. Contemporary equality law was a
response to histories of both public and private discrimination in Canada. Statutory protections for equality and non-
discrimination emerged in the post World War II era and were expanded and consolidated in the 1960s and 1970s.
Constitutional reforms in the 1980s enshrined equality in the Canadian Charter of Rights and Freedoms. Since then,
equality jurisprudence has expanded the interpretation of discrimination to include direct, indirect and systemic
discrimination. Courts have rejected formal equality to embrace expansive notions of substantive equality in
interpreting constitutional protections. Even with such strides over the last decades towards robust equality and non-
discrimination principles and protections, just and effective implementation of their promise remains a pressing
challenge for Canada.

questions from MEPs in the Committee on Women's Rights and Gender Equality, Committee on Employment and
Social Affairs and Committee on Civil Liberties, Justice and Home Affairs. During the hearing, she made a number of
commitments which are highlighted in this document. These commitments refer to her portfolio, as described in the
mission letter sent to her by Ursula von der Leyen, President-elect of the European Commission, including:
- Fight against discrimination;
- Rights of Persons with Disability;
- European Gender Strategy;
- Work–Life Balance Directive;
- International Partnerships:Empowering women and girls;
- Cooperating with the European Parliament and with other Commissioners.

Riassunto This briefing is one in a set looking at the Commissioners-designate and their portfolios as put forward by Commission
President-elect Ursula von der Leyen. Each candidate faces a three-hour public hearing, organised by one or more
parliamentary committees. After that process, those committees will judge the candidates' suitability for the role based
on 'their general competence, European commitment and personal independence', as well as their 'knowledge of their
prospective portfolio and their communication skills'. At the end of the hearings process, Parliament votes on the
proposed Commission as a bloc, and under the Treaties may only reject the entire College of Commissioners, rather
than individual candidates. The Briefing provides an overview of key issues in the portfolio areas, as well as
Parliament's activity in the last term in that field. It also includes a brief introduction to the candidate.

Riassunto The European Union (EU) is committed to eliminating inequalities and promoting gender equality 'in all its activities'
and has made considerable advances over the years. Nevertheless, the situation remains uneven across the EU, and
in recent times progress has slowed, stalled or even regressed in some areas. Yet, the evidence points clearly to the
benefits of gender equality for individuals, the economy and society as a whole. Public opinion surveys show that a
large majority of Europeans agree that promoting gender equality is important for a fair and democratic society, the
economy and for them personally and that a growing share of citizens would like the EU to do more in this area.
Europeans also expect increased EU action on related policies. During the last legislative term, as part of a broader
gender equality programme, the EU institutions have been working on proposals for new EU laws to improve work-life
balance and combat violence against women. Promoting equality between women and men will remain one of the
major challenges in the coming years. Demographic trends, technological developments and changes to the way we
work are just some of the issues where different impacts on women and men will need to be considered. Options for
further EU involvement could include better implementation and enforcement of existing legislation, moves to
modernise it, fill gaps in protection and address emerging issues, and non-legislative measures such as data collection
and monitoring, awareness-raising, and support for national and grassroots initiatives. It will require the political will at
all levels to tackle issues across a broad spectrum of policies, together with the provision of the necessary institutions,
tools and resources to put that resolve into action. This is an update of an earlier briefing issued in advance of the
2019 European elections.

Riassunto 2017 was a year during which the EU saw both progress and setbacks in fundamental rights protection. For example,
while the adoption of the European Pillar of Social Rights was a further step towards more equality, setbacks were
encountered in the area of the independence of the judiciary, the work of civil society organisations and women’s
rights. The Commission, the EU Fundamental Rights Agency and the Parliament regularly monitor the situation of
fundamental rights in the EU. A LIBE committee report on the situation of fundamental rights in 2017 is scheduled for
debate in plenary during January.

Riassunto Although on the EU agenda for decades, recent events, such as the migration crisis and the issues with the rule of law
in some Member States, have brought the issue of values back into focus. EU values are those of equality, freedom
and respect for human rights. Freedom of religion and belief has significant protections in the EU and under the
international legal framework. Religion, represented by churches, religious communities and other actors, is also a
significant factor in the protection and promotion of human rights, both in the world and in the European Union.
International human rights bodies have even formalised the participation of religious actors, mostly through exchanges
and dialogues, and the European Union is no exception. Its Article 17 Dialogue with churches, religious, philosophical
and non-confessional organisations offers an opportunity for those groups to make their voices heard at EU level.
Religious actors have made significant contributions in, for example, migration, deradicalisation, social justice and
education for tolerance. However, the role of religion in the human rights arena is sometimes perceived as challenging,
since some religious actors and some secular human rights actors may not see eye-to-eye in some areas. Experts
therefore suggest that it is important to maintain that all human rights have equal worth, that everyone who may be
affected by the issue is included in the dialogue, and to try to find a compromise that will not alienate any party from
further cooperation.

Riassunto Algorithms, are step-by-step procedure for solving a problem, usually expressed in computer code as a set of
instructions for a computer to follow in order to complete a task. Day-to-day decisions around the world are
increasingly based on data science techniques powered by machine learning algorithms that are gradually making a
meaningful impact on human lives. For example, the operation of intermediary platforms that propose accommodation
(AirBnB) or transportation alternatives (Uber) are extensively using algorithms. Algorithms implicitly or explicitly are not
neutral as they comprise essential value-judgments that can potentially have race or sex biases. This raises an
important question: is it possible to develop and ensure that algorithms are ethical?

Riassunto The citizens of the European Union communicate in its 24 official languages, approximately 60 regional and minority
languages, and 31 national and regional sign languages. Some of these have many millions of native and foreign
speakers, whereas others are spoken by just a few thousand people each. Dominant languages can threaten the
survival of 'smaller' ones with many fewer native speakers and which thus need protection. Multilingualism policy in
areas such as language teaching and learning, and translation and interpretation, is necessary to facilitate
communication among various language communities and for supporting languages with fewer speakers. Moreover,
unaddressed language barriers hinder the economy of individual Member States and the EU in general. The digital
shift and ICT technologies open rich possibilities of expression and business, yet these are not spread equally across
language communities. Smaller languages are under-represented in digital environments, which could entail their
digital extinction. New technologies can facilitate language learning, translation and interpretation. However,
paradoxically, the smaller languages, which could benefit the most from these technologies, are the least resourced in
data, in researchers specialising in both language and technology, and in human and financial means. Some solutions
to these challenges could emerge from EU-supported and coordinated projects, a clear focus on language
technologies in EU policies, and dedicated funding, provided in the clear awareness that these challenges not only
have a human dimension but also economic implications for the digital single market and the economy of the EU as a
whole.

writer claims that in order to understand the situation of political representation rights of ethnic and linguistic minorities
in Estonia and Latvia it is essential to provide a historical-political framework that contextualizes the presence of such
substantial minorities in the two countries and justifies the type of relationship existing with the majority of nation
holder.
He also suggests that from one side, full integration is the goal that needs to be pursued, while at the same time it's

Riassunto This study specifically focuses on EU action and cooperation concerning equality and the fight against racism and
xenophobia. Despite existing EU legislation and action it argues that there are still significant gaps and barriers to

European Union. The impact of the gaps and barriers identified – in action and cooperation – at EU level are assessed
both in terms of economic impact and their impacts on economic rights and freedoms. To address these gaps and

Riassunto On 13 December 2017, just a few days after the United Nations' Human Rights Day, the European Parliament (EP)
adopted in plenary its annual resolution on human rights and democracy. Addressing the numerous pressures exerted
on human rights in 2016, the resolution calls upon the European Union to place human rights at the centre of EU
relations with all third countries and to lead by example. The resolution hails the step forward made for the
empowerment of women, but also warns of two new challenges – backward steps – to human rights in the world. One
is brought about by new technological developments, and the other by new trends in terrorism involving psychological
intimidation through the destruction of heritage sites.

Riassunto The present note aims to assess how changes introduced in 2013 have (not) improved beneficiaries’ experience in the

Riassunto This study, commissioned by the the European Parliament’s Policy Department for Citizens’ Rights and Constitutional
Affairs at the request of the Committee on Petitions, was prepared to assess the nature and extent of employment
precariousness in the framework of EU’s fundamental rights and EU employment law. The analysis focuses on two
broad areas, namely atypical forms of employment and franchising. The report identifies a number of ‘protective gaps’
at various levels of regulation and puts forward policy recommendations that are informed by the need to adopt holistic
and comprehensive action for addressing what emerges as a constantly moving target.

Riassunto The power to levy taxes is central to the sovereignty of EU Member States, which have assigned only limited
competences to the EU in this area. The development of EU tax provisions is geared towards the smooth running of
the single market, with the harmonisation of indirect taxation having been addressed at an earlier stage and in greater
depth than that of direct taxation. Alongside these efforts, the EU is stepping up its fight against tax evasion and
avoidance, which constitute a threat to fair competition and are the cause of a major shortfall in tax revenues.
According to the Treaty, tax measures must be adopted unanimously by the Member States. While tax policy is greatly
influenced by the case law of the European Court of Justice, the European Parliament has only the right to be
consulted in this regard, except in budgetary matters, for which, as co-budgetary authority, it shares decision-making
powers with the Council.

Riassunto 11 December 2016 marks the 15th anniversary of China's accession to the World Trade Organization (WTO). In 2001,
after arduous negotiations with key WTO members, China agreed not only to extensive market access commitments
but also to substantial non-reciprocal rules obligations. This was unprecedented in WTO history. Most WTO disputes
involving China, notably in the field of trade remedies, have been linked to these tailor-made rules for China. China has
exhibited timely and qualitatively sound compliance with WTO rulings. But its narrow letter of the law compliance has
at times been found not to reflect the spirit of the legal provisions at issue, with WTO-inconsistent regulations having
remained in place or re-emerged. In the Doha Development Round of WTO multilateral negotiations China has so far
taken a backseat rather than a leadership role. Domestic resistance to reform in sensitive areas on economic and
ideological grounds has been a crucial factor in China's absence from the WTO Agreement on Government
Procurement. Past US opposition has been key for its non-participation in the Trade in Services Agreement.
Uncertainties about ratification by the US Congress of the US-led Trans-Pacific Partnership and future US trade policy
under President Donald Trump may reverse the past trend of China's marginalisation from shaping global rules outside
the WTO. At the same time this may lower China's ambition to shift gradually from rather shallow to EU-style 'deep and
comprehensive' free trade agreements (FTAs) and may induce it to promote its own rules more assertively by
leveraging its economic weight in predominantly bilateral relations under its One Belt, One Road (OBOR) initiative.

Affairs at the request of the LIBE Committee. It evaluates the implementation, impact and outcomes of National Roma
Integration Strategies in a selection of Member States (Bulgaria, France, Hungary, Italy, Romania, Slovakia, and
Spain) in the broader context of the EU Framework for National Roma Integration Strategies. It concludes that these
strategies suffer from severe implementation gaps and that Roma populations continue to live in significant socio-
economic deprivation, suffer extensive discrimination and high levels of anti-Gypsyism. The study puts forward
practical policy recommendations for enhanced implementation of Roma integration strategies in Member States, and
for improved policies at the EU level that could support a more effective integration of disadvantaged Roma EU
citizens.

Riassunto In 1995 − which was the United Nations (UN) Year for Tolerance − the UN established 16 November as the
International Day for Tolerance. The day was intended to serve as a reminder of the dangers of intolerance and the
necessity to promote tolerance through raising public awareness, education and other means. Recent research and
surveys have shown that this reminder is still very much needed. The EU has made many efforts to combat intolerance
in Member States and has stepped up action in recent years.

Riassunto Marginalised communities largely live on the fringes of European society, often with little access to the services that
the rest of the population take for granted. The responsibility for marginalised groups lies primarily with the Member
States, yet the objective of social cohesion also calls for an EU-level response. While there is no definition of
marginalised communities under the EU Treaties, certain groups such as the Roma suffer from a combination of
factors including discrimination and material deprivation, and are therefore a particular area of focus in discussions on
marginalised communities. EU structural funds have not always taken full account of these communities during
previous programming periods, while their involvement in the preparation and implementation of programmes has
been limited. The current 2014-2020 cohesion framework puts forward new measures with a wider scope for improving
the situation of such groups, including an investment priority targeting marginalised communities. Many stakeholders
argue, however, that Roma issues need to be mainstreamed across all policy areas in order to achieve lasting
structural change. The European Parliament has prepared an own-initiative report on marginalised communities and
cohesion policy, to help feed into the discussions on the future programming period, and has been in the vanguard of
EU-level initiatives to improve the living conditions of these groups. Ultimately, however, the inclusion of marginalised
communities will depend on strong political will from local and national authorities on the ground.

Riassunto Upon request by the FEMM Committee, this study explores the results of the 2014 European Parliament elections in
terms of gender balance of MEPs. The study uses case studies and statistical analyses of the election results to
establish the main barriers to women being elected. The factors explored include the type of electoral system used,
political parties’ candidate list selection processes and strategies used by women political candidates. The study
presents recommendations for improving gender balance in the European Parliament.

Riassunto The human right to water has been firmly established and its implications for policy-making have been discussed in
many fields. Thus far, this has hardly been the case for conflicts over water. This study discusses what it means to
integrate human rights in the context of governing water and addressing conflicts over water. A human rights
perspective on conflicts over water will help formulating equitable water governance strategies. To support such
developments, the EU should integrate human rights in policies and other measures to address water conflicts at all
levels. The EU’s activities should be guided by the human rights principles of non-discrimination and equality;
participation and access to information; accountability and access to justice; and a priority for water uses as far as they
are necessary for the realisation of human rights. This relates to internal legislation and policies, development
cooperation, engagement in transboundary basins, political dialogues with partner countries, international fora such as
the UN Human Rights Council, and the negotiations on the post-2015 development agenda. The European Parliament,
specifically, should support such initiatives with resolutions, engagement in UN and inter-parliamentary fora, and
enhancement of public awareness.

Riassunto Nepal may well be popular worldwide for Everest climbing with Sherpa's' help, yet it remains one of the poorest
countries in the world. A 10-year guerrilla conflict ended in 2006 and led to the country's transition from monarchy to
republic. However, the political parties have so far been unable to reach a compromise on a new constitution, or to
provide the political stability that could allow this 30-million-strong multi-ethnic country to develop its economy.

Riassunto Statelessness is a significant human rights challenge: it is often a product of human rights problems, such as gender or
racial discrimination, while it also has a serious and lasting impact on the enjoyment of other human rights. This study
explores how the European Union can play a greater role in the fight against statelessness around the world as part of
its external action on human rights issues. It demonstrates the nexus between statelessness and the EU’s current
human rights priorities and identifies the ways in which the EU has already contributed to addressing statelessness in
its external action.
The study then discusses the ways in which the EU can strengthen its contribution to the fights against statelessness
through multilateral action, bilateral action and improved institutional arrangements. Finally, the paper identifies a set of
three thematic and five country priorities for EU engagement on statelessness, providing recommendations for action
in each case.
