Communication should not generally strive for maximum transparency. The optimum degree of transparency varies between different aspects of monetary policy and banking supervision. Although the ECB already communicates very openly with the public and achieves a very high level of transparency in all aspects, we see room for improvement in its communication strategy in several respects. This means that both developing and richer countries must commit to spending and using aid more effectively. Public funding is not enough to cover all needs, but it can leverage initiatives from civil society and the private sector. The increase in stakeholders and intervention methods, both in terms of numbers and variety, combined with the necessity to address needs in the field more precisely, has led to a global rethinking of how to assess development. High-level forums and stakeholder networks have helped to fine-tune the main principles of development effectiveness and to shift from a donor-recipient relationship to a more cooperative framework. Methods and tools have improved and led to better planning, implementation and appraisal of development projects. The EU has been closely involved in designing and implementing the effectiveness principles. Since 1946, the UN has undergone a number of reforms either in whole or in part. The term 'reform' has proved troublesome for UN member states on account of its lack of clarity and the lack of consensus as to execution. This is particularly apparent in the scepticism expressed by the United States (US) in 2018 regarding the need for global governance, the importance of UN Security Council decisions such as the Iran nuclear deal, and the efficiency of the United Nations. This briefing explains how the current reform differs from previous ones, in as much as it focuses on management and addresses the criticisms of a lack of accountability and transparency, ineffectiveness, and the deficit in trust between the organisation and its member states in the current system. The United Nations reform agenda centres on three key areas: development, management, and peace and security. First, development reform will bring a bold change to the UN development system in order to achieve the goals of the 2030 Agenda for Sustainable Development. This will be centred on the creation of a new generation of country teams led by an independent team of UN country experts ('resident coordinators'). Second, the simplification of processes, increased transparency and improved delivery of mandates will form the basis of a new management paradigm for the secretariat. Third, peace and security reform will be underpinned by placing priority on conflict prevention and peacekeeping, increasing the effectiveness and coherence of peacekeeping operations and political missions. Two years after its launch, the reform process is starting to bear fruit, with implementation set to begin in 2019 and a focus on streamlining, accountability, transparency and efficiency. However, the reform process does not make explicit mention of bolstering human rights. This briefing also explores the possibility of capitalising on the current reforms so as to boost the indivisibility of human rights, while taking stock of stakeholders' reactions to the UN reforms under way. Currently there are 36 of them and they have been operating under very diverse conditions. This study provides an overview of the different decentralised EU agencies according to a number of criteria; including their functions, legal bases, sources of financing, respective roles of Parliament, Council, Commission and Member States, stakeholder involvement and transparency. From the establishment of the European Ombudsman, personalities and the open- ended character of the notion of maladministration have been relevant in shaping the activity of the office. Maladministration is widely accepted to be a sphere of inappropriate behaviour of the administration that goes beyond simple illegality. The particularity of the Ombudsman lies therefore on the fact that it is able, through the exercise of 'soft power', to tackle issues that would escape the scrutiny of the Court of Justice of the EU. This paper provides an overview of the activity of the Ombudsman, and attempts to identify the main areas of activity in quantitative terms, the main institutions to which the Ombudsman addresses inquiries and recommendations and highlights the proactive role exercised by this body so far. The compliance rate with the recommendations of the Ombudsman is rather high, although it would seem to decrease where the Ombudsman, by issuing critical remarks, exercises an 'educational' function. This paper also sets out some proposals to modify the Statute, with some less-extensive proposals, that would take into account already established practices, and other more far-reaching proposals, that would need however to be carefully considered so as not to distort the nature of the body. As the EU VAT system is undergoing profound modernisation, this study seeks (i) to take stock of the current state of play, (ii) to assess the current regulatory framework and the proposals under discussion, and (iii) to offer a selection of recommendations. An initial conclusion is that, while the European Commission has put a considerable amount of work into the modernisation of the EU VAT system, remaining risks of fraud cannot be ignored. A second substantial conclusion is that a different approach and the use of new technologies would allow the Member States to remove significant obstacles that currently impede an effective fight against VAT fraud. Part and parcel of recent legislation on transparency (Sapin II package), it was adopted on 9 December 2016, providing a regulatory framework for lobbying activities and establishing a mandatory national register ('le repertoire') for lobbyists. In a step-by-step process, first, the repertoire, in which all active interest representatives must sign up, was created on 1 July 2017. After registering by 1 January 2018, interest representatives were then under the obligation to report their lobbying activities in this repertoire by 30 April 2018. The repertoire, with just over 1 00 registrants to date, is overseen by the 'Haute Autorité pour la Transparence de la Vie Publique' (HATVP). In France, the cultural acceptance of lobbying as a profession has been slow, and the new law will make a huge difference in terms of making lobbying activities public, with a regulation closely following the Irish example. The Sapin II package aims for a general increase in public accountability and transparency of the decision-making processes. Some incremental steps in this direction had been taken previously, primarily with the establishment of the HATVP in January 2014 as an independent body to oversee the integrity and transparency of the national public institutions. In order to mitigate the reputational damage to public institutions by problematic use of the 'revolving door', this phenomenon is increasingly being regulated at national level. In the United States, President Trump recently changed the rules put in place by his predecessor to slow the revolving door. As shown by press coverage, the US public remains unconvinced. Scepticism may be fuelled by new exceptions made to the rules – retroactive ethics pledge waivers – and the refusal of the White House to disclose the numbers or beneficiaries of said waivers. Watchdog organisations argue that not only has the Trump administration so far failed to 'drain the swamp', it has ended up doing quite the opposite. In the EU, where revolving door cases are increasingly being covered in the media, both the European Parliament and Commission have adopted Codes of Conduct, regulating the activities of current and former Members, Commissioners, and even staff. The European Ombudsman, Emily O'Reilly, has on numerous occasions spoken out in favour of further measures, such as 'cooling-off periods', and has carried out several inquiries into potentially problematic revolving door cases. Following calls from Parliament, the Juncker Commission adopted a new and stronger Code of Conduct for Commissioners early in 2018. Even so, no one single Code can hope to bring an end to the debate. The EU follows a sectoral approach to regulating the marketing and sale of financial products, which results in segmentation and arbitrage risks. The paper argues that the European Supervisory Authorities should adopt more harmonised regulatory and technical standards to reduce these risks and ensure more effective enforcement by Member State authorities. The Commission performed its own mid-term evaluation and asked experts to evaluate the programme's specific instruments. In parallel, the European Parliament, the Council of the EU and the advisory committees conducted their own, separate evaluations of the programme. The Commission adopted its conclusions on the interim evaluation of Horizon 2020 in January 2018, confirming that the programme was relevant and presented clear EU added value. Implementation was considered to be efficient and the first results suggested that the programme was also effective in reaching its objectives. The integration of research and innovation and the Horizon 2020 pillar structure provided for greater internal coherence compared with previous framework programmes. All the evaluations highlighted four key issues to be addressed by the next FP. First, the programme budget needs to match better the funding required to bring the success rate back to acceptable levels. Second, the unbalanced distribution of FP funding across the EU raises concerns regarding the impact of the use of the excellence criterion and calls for changes to enable the various EU funds to generate more synergistic effects so as to maintain EU competitiveness and promote EU cohesion in research and innovation. Third, the evaluations highlight the will to improve the shared, multi-level governance between the EU, Member States and regions and to promote the co- design and co-construction of the FP with the public and civil society. Finally, there is widespread agreement that the EU research and innovation funding landscape has become too complex and should be streamlined, questioning the EU added value of each of the instruments and partnerships. Broadly speaking, tax havens provide taxpayers, both legal and natural persons, with opportunities for tax avoidance, while their secrecy and opacity also serves to hide the origin of the proceeds of illegal and criminal activities. One may ask why establishing a list of tax havens is useful. Drawing up such a list started with the actions to stop harmful tax practices arising from the discrepancy between the global reach of financial flows and the geographically limited scope of jurisdictions, matching or inside national borders. This difference is central to the inter-connected issues of tax avoidance, tax evasion and fraud, and money laundering. Whatever name is used (tax haven, offshore centre, non-cooperative jurisdiction) they all have in common that they make it possible to escape taxation: low or zero taxation, a fictitious residence (with no bearing on reality) and tax secrecy. The last two are key for hiding the ultimate beneficial owner, and consequently for money laundering. In short, the tax-haven issue reveals the discrepancy between real economic activity and the form and appearance given to it, through complex and global schemes. In the EU, the process of adopting a common list of non-cooperative tax jurisdictions was initiated as part of efforts towards good governance in tax, and the external dimension thereof. The European Commission and Canada subsequently renegotiated the relevant provisions of the Comprehensive Economic and Trade Agreement (CETA) to establish a new investment court system (ICS). The ICS departs substantially from the arbitration model, in particular on the appointment of judges. Procedurally the ICS remains similar to treaty-based arbitration proceedings and retains all the innovations introduced in the early draft of CETA. Those innovations aim, among other things, to prevent ‘forum shopping’ and abuse of the system. Some of the innovations introduced will require further decisions in CETA’s established Committees, such as on the code of conduct and decisions on appellate body judges. Some concerns raised regarding the basis for differences between ISDS and domestic court systems persist in the ICS context. These relate both to the different treatment between foreign and domestic investors, and to uncertainty regarding the compatibility of the ICS system with the principle of autonomy of the EU legal order. On this last point, however, the ICS framework can be distinguished for various reasons from past opinions on the European and Community Patent Court and the EU’s accession to the European Convention on Human Rights.
